1. Purpose of the site. SkinTour.com provides information for educational purposes to help you understand your skin and make your own decisions about enhancing its appearance. It does not replace a consultation with a physician or other qualified health provider. Please consult your health care provider without delay if you suspect you may be ill, and see an emergency provider if you have an urgent concern.

2. Not medical advice. Nothing on the site offers to or purports to diagnose or treat a condition, give medical advice of any kind, or constitute the practice of medicine. SkinTour.com is not intended to provide a treatment plan or the management of any medical condition. The site does not create a physician-patient relationship or a confidential or privileged relationship of any kind, and you agree as a user that no such relationship exists. You understand and agree that Dr. Irwin's answering of a question is not a response to an individual about any specific medical condition or issue but rather the provision of general information.

3. Skin Care and Acne Tests. The site offers a skin care test and/or an acne test for users. These tests are not intended to provide individual medical advice. The tests, and the product information provided after each test is completed, are generalized and may not apply to every individual. Product results will vary for each person. Neither SkinTour LLC nor Dr. Irwin is responsible for individual results.

4. Source & Use of Content. The content on SkinTour.com is based Dr. Irwin’s personal training, experience, research, and study. It has not been peer-reviewed and in some cases, consists of Dr. Irwin’s opinions. Health information changes rapidly, and the content presented here may not reflect the most current research findings, or all available information that may be relevant to a particular issue. All information is provided "as-is," without warranty. The use of any content or information on this site is solely at your own risk.

5. Dr. Irwin’s self-interest. Dr. Irwin has not been paid to promote the products on this site and has no financial ties to or interests in to the companies whose products are offered on this site. If the skin care products identified on this site are sold on this site or by linking users to another site, SkinTour LLC may benefit from that sale. SkinTour LLC is owned by a member of Dr. Irwin’s immediate family.

6. General limitation of liability. Your sole and exclusive remedy for any dispute with us is the cancellation of your registration. We shall not be liable for any indirect, special, or consequential or exemplary damages resulting from any claim arising out of your use of or inability to use the site, even if we knew or should have known of the possibility of such damages. Because some state or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the extent permitted by law.

7. Disclaimer of Warranties. We provide the site "as-is," "with all faults" and "as available." We disclaim all warranties, guarantees or conditions. Without limiting the foregoing, to the extent permitted by law, we exclude and disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.

8. Indemnification. Upon a request by us, you agree to defend, indemnify, and hold harmless us, our employees, contractors, officers, directors, agents, parent, other affiliated companies, and suppliers, from all liabilities, claims, and expenses, including attorney's fees, that arise from your use or misuse of this site. We reserve the right to assume control of the defense of any third party claim that is subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

9. Use of any term in its familiar form shall be understood to be use of that term in its fully protected and trademarked form. The use of the term "Botox" shall be understood to refer to BOTOX® Cosmetic, and the use of the term "Juvederm" shall be understood to refer to Juvèderm™ Injectable Gel.

10. Privacy Policy. You agree to the privacy policies as set forth in our Privacy Policy.

11. Arbitration and Governing Law. Any disputes arising from any aspect of this site shall be governed by the laws of the State of Washington without regard to any conflicts of laws principles. Any claim shall be resolved, upon the election of the claimant or SkinTour LLC by binding arbitration pursuant to this provision and the applicable rules of J.A.M.S./Endispute and under the Federal Arbitration Act. If arbitration is chosen by any party, neither party will have the right to litigate that claim in court or have a jury trial on that claim, or to engage in pre-arbitration discovery except as provided for in the applicable arbitration rules.
